I also release and forever discharge the above groups from all actions, suits, proceedings, claims, demands, losses, damages, penalties and fines however arising (including negligence). This includes, but is not limited to behaviour that BOW management considers inappropriate due to safety concerns or its disruptive, discriminatory or abusive nature. By entering the BOW festival you agree that if your participation is terminated by BOW management you will immediately vacate the location at which the event is held, will not be entitled to a refund and waive any claim against BOW. I understand that my participation in the Festival is subject to accepting and complying with the Event Terms and Conditions as listed below: iii. Pilots participating in the festival and competitions must have Public Liability Insurance for the duration of the festival for no less than $1,000,000.00 NZD. Proof is to be provided via email or not later than Pilot check-in at Registration. iv. All pilots and balloon teams are required to adhere to all Health and Safety policies, procedures and expectations. Failure to do so may result in your participation being terminated by BOW Management v. Pilots participating in the event must ensure they are familiar with the PZ’s in the area and ensure that every effort is made to adhere to these. Pilots from outside the area must be familiar with flying and landing conditions particular to the Waikato. vi. Balloons participating in the event must have a current Certificate of Registration and Certificate of Airworthy. (To be presented at Registration Check In) vii. Any pilot involved in a flying related incident during the festival must complete an incident report and submit to the Flight Director immediately. viii. Pilots are responsible for any loss or damage to property or personal injury they cause while participating in the event. ix. Balloons over Waikato Trust are not responsible for any loss or damage to balloons, balloon equipment or belongings during transportation to and from New Zealand, and while in New Zealand. x. Pilots using vehicles supplied by Balloons over Waikato and/or BOW sponsors are responsible for any claims which may be the result of an accident or damage to the vehicle whilst in the pilot’s possession regardless of who is driving the vehicle. xi. The Pilot-in-command must have a minimum of 30 hours pilot in charge flight time. xii. Participating pilots must not operate commercially and carry paying passengers, or other non paying passengers unless required for flight such as crew. xiii. Any equipment supplied during the festival must be returned to Balloons over Waikato at the conclusion of the festival. Any loss or damage will be the responsibility of the person to whom it was supplied and you may be sent an invoice at the conclusion of the festival. xiv. Alcohol shall not be consumed 8 hours before any flying and is not to be consumed or displayed in public arenas, public view or prior to participating in any festival event. Prohibited substances are not to be used at any time. Failure to adhere to this with either alcohol or prohibited substances will result in removal from the event. xv. All pilots and balloon teams participating in the festival must respect the integrity of the event and ensure that the event’s excellent Safety Record and Land Owner relationships are maintained. xvi. Any repairs carried out on balloons during the festival must be paid for by pilots. Registration acceptance is subject to pilots agreeing to the terms and conditions as outlined above.
